1. Acceptance of Terms

By accessing our website at www.ncrhomehealthcare.com or engaging the services of Shiv International Home Care Private Limited ("the Company," "we," "us" or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and Shiv International Home Care Private Limited, registered in Gurugram, Haryana, India.

2. Services Offered

The Company provides home healthcare services including but not limited to: Home ICU Service, Tracheostomy Care, Home Nursing, Doctor Visits at Home, Physiotherapy at Home, Medical Attendant (GDA) services, Medical Equipment Rental and Sales, Injections and Dressing at Home, and 24×7 Pharmacy delivery.

All services are provided within the Gurugram, Haryana and NCR region. Service availability in specific locations is subject to confirmation at the time of booking.

3. Service Agreement and Booking

A service relationship is established when the Company confirms acceptance of your service request either verbally, by phone or in writing. The Company reserves the right to decline any service request at its sole discretion.

All service bookings, whether made by phone, WhatsApp, website form or email, are subject to availability of qualified professionals and are confirmed only upon explicit acknowledgement from our care coordinator.

4. Fees and Payment

Fees for services are communicated to clients prior to the commencement of care. All fees are stated in Indian Rupees (INR) inclusive of applicable taxes unless otherwise specified.

• Payment terms are as agreed in the individual service contract or care plan.
• The Company accepts payment by cash, UPI, bank transfer and other methods as specified at the time of service.
• Invoices are issued for all services rendered. Clients are requested to review invoices and raise any disputes within 7 days of receipt.
• Charges for equipment rental begin from the date of delivery and end on the date of collection, as confirmed in writing.

5. Cancellation and Refund Policy

The following cancellation terms apply unless otherwise agreed in a service contract:

• Cancellation with 24+ hours notice: No charge.
• Cancellation with 4–24 hours notice: 50% of the scheduled session fee may be charged.
• Cancellation with less than 4 hours notice: Full session fee may be charged.
• No-shows: Full session fee will be charged.
• Refunds, where applicable, will be processed within 7–10 working days by the original payment method.

The Company reserves the right to cancel or reschedule services due to unavailability of professionals, emergencies or force majeure events. In such cases, clients will be notified as early as possible and a full refund or rescheduling will be offered.

6. Client Responsibilities

Clients and their family members agree to:

• Provide accurate and complete information about the patient's medical condition and history.
• Ensure a safe working environment for our healthcare professionals, free from harassment, abuse or health hazards.
• Follow care instructions, medication schedules and recommendations provided by our professionals.
• Notify us promptly of any changes in the patient's condition or requirements.
• Be present or have a responsible adult present during the first service visit.
• Not request our professionals to perform services outside the agreed care plan without prior authorization from the Company.

7. Limitations of Liability

While the Company takes every reasonable precaution to ensure safe, high-quality care, we cannot guarantee specific medical outcomes. Healthcare outcomes depend on many variables beyond our control including the patient's pre-existing conditions, compliance with care instructions and individual response to treatment.

To the maximum extent permitted by applicable Indian law, the Company's liability for any claim arising from the provision of services shall not exceed the total fees paid by the client for the specific service giving rise to the claim in the preceding 30 days.

The Company shall not be liable for indirect, consequential, incidental or special damages arising from the use of our services or website.

8. Professional Standards and Qualifications

All healthcare professionals engaged by the Company hold the relevant professional qualifications and registrations required under Indian law. The Company maintains records of all credentials and conducts regular checks. Clients may request verification of a professional's credentials prior to commencement of care.

9. Medical Equipment Rental Terms

• Equipment is provided in good working condition and has been serviced and sanitised prior to delivery.
• Clients are responsible for the proper use and care of rented equipment as per instructions provided.
• Damage beyond normal wear and tear will be charged to the client at the cost of repair or replacement.
• Equipment must be returned in the same condition as delivered. The Company reserves the right to charge for missing accessories.

10. Intellectual Property

All content on the website www.ncrhomehealthcare.com including text, images, logos, graphics and code is the intellectual property of Shiv International Home Care Private Limited or its licensors and is protected under Indian copyright and trademark law. No content may be reproduced, distributed or used without prior written permission from the Company.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after changes constitutes your acceptance of the revised terms. We encourage you to review these Terms periodically.
